Commencement of the Assisted Decision-Making (Capacity ) Act 2015 – 21st November 2022

The Department of Children, Equality, Disability, Integration and Youth (DCEDIY) have confirmed to us that the ‘go live’ date for the full commencement of the Assisted Decision-Making (Capacity) Act 2015 is November 21st 2022.

They have also confirmed that it is the intention of the Department to move the Assisted Decision-Making (Capacity) (Amendment) Bill 2022 through the Seanad as quickly as possible. This process will begin on Thursday this week when the Bill is introduced to the Seanad for the second stage debate.

 

Preparations for commencement and implementation

We are aware that many organisations, services and groups have been working hard to prepare for commencement. We are interested in finding out about any awareness-raising, communication or other initiatives you have been undertaking to promote and prepare for the Act in your service.  If you have any information you would like to share about your initiatives to date we would be very interested in showcasing them in our next newsletter. Please send a short article (100-150 words) on your piece of work to adm@hse.ie by deadline Friday 23rd September with any supporting documentation or photographs.
